1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Traveler," "Customer," "Client," or "you") and Bigtime Travel ("Company," "we," "us," or "our"), a travel services company operating from Shop No. 13, T Nagar Shopping Complex, Chennai, Tamil Nadu 600017, India. By accessing our website www.bigtimetravel.shop, using our services, making a booking, or communicating with us in any manner, you agree to be bound by these Terms in their entirety.

If you do not agree with any part of these Terms, you must not use our website, services, or make any bookings through us. Your continued use of our services following the posting of any changes to these Terms constitutes acceptance of those changes. We recommend that you print or save a copy of these Terms for your records.

These Terms are in addition to and not in lieu of any specific terms and conditions that may be provided to you at the time of booking a particular tour package. In the event of any conflict between these general Terms and package-specific terms, the package-specific terms shall prevail to the extent of the conflict.

We act as an intermediary between Travelers and Third-Party Service Providers. While we carefully select and partner with reputable service providers, we do not own, operate, or control the hotels, airlines, transport companies, or activity providers whose services are included in our tour packages. Each Third-Party Service Provider is an independent contractor and is subject to their own terms and conditions.

4. Booking and Reservation

4.1 Booking Process

All bookings are subject to availability and confirmation. Submitting a booking request does not constitute a confirmed booking. A booking is considered confirmed only when you receive a written or electronic Booking Confirmation from us along with a unique booking reference number.

4.2 Information Accuracy

You are responsible for providing accurate, complete, and up-to-date information at the time of booking, including but not limited to full names as per government-issued ID, correct dates of birth, accurate contact details, valid ID numbers, and any special requirements. Any errors in the information provided may result in denial of services by Third-Party Service Providers (such as hotel check-in refusal or flight boarding denial), and Bigtime Travel shall not be liable for any losses, expenses, or inconvenience arising from such errors.

4.3 Booking for Others

If you are making a booking on behalf of other Travelers, you confirm that you have obtained their consent to share their personal information with us and that they agree to be bound by these Terms. You are responsible for ensuring that all Travelers in your booking are aware of the itinerary, terms, and conditions, and any special requirements or restrictions.

4.4 Booking Modifications

Requests for changes to a confirmed booking (such as change of dates, change of hotel, change of room type, addition or removal of travelers) must be submitted in writing and are subject to availability and applicable modification fees. Modification fees vary based on the nature of the change, timing of the request, and the policies of the Third-Party Service Providers involved. We will inform you of any applicable fees before processing the modification. Not all modification requests can be accommodated.

5. Pricing and Payments

5.1 Tour Package Pricing

All tour package prices are quoted in Indian Rupees (INR) or US Dollars (USD) as specified and are inclusive of applicable Goods and Services Tax (GST) unless otherwise stated. Prices are per person unless explicitly stated otherwise. Our package prices typically include accommodation, transportation as per itinerary, meals as specified in the package, guided tours, activity fees as mentioned, and applicable taxes. Prices may not include items such as personal expenses, tips, optional activities, visa fees, travel insurance (unless specified), and items not mentioned in the package inclusions.

5.2 Price Changes

Tour package prices are subject to change without prior notice due to factors including but not limited to fluctuations in hotel rates, fuel prices, airline fares, taxes, government levies, currency exchange rates (for international components), seasonal demand, and special events or festivals at the destination. However, once a booking is confirmed and full payment is received, the price will not be increased except for changes in government taxes or levies, in which case the difference will be communicated to you and must be paid before the trip commences.

We accept the following payment methods: Bank Transfer (NEFT / RTGS / IMPS / UPI), Credit Card and Debit Card (through secure payment gateway), Cash payment at our office (against proper receipt), and Wire Transfer (for international clients). All payments must be made to authorized bank accounts or payment channels as communicated by us. We are not responsible for payments made to unauthorized accounts or individuals. Payment will be considered received only when it is credited to our account.

5.5 No Refund for Unused Services

If you fail to utilize any services included in your tour package (such as missing a scheduled tour, not using a hotel night, skipping a meal, or not participating in an activity), no refund will be provided for the unused portion. This applies regardless of the reason for non-utilization.

6. Cancellation and Refund Policy

6.1 Cancellation by the Traveler

If you wish to cancel a confirmed booking, you must notify us in writing (via email or written letter). Cancellation charges will apply as follows, calculated from the date we receive your written cancellation notice:

Certain components of a tour package may be non-refundable as per the policies of the respective Third-Party Service Providers. These include but are not limited to: flight tickets (airline cancellation policies apply), train tickets (railway cancellation rules apply), certain hotel room categories or rate plans, special event tickets, and peak season bookings. We will inform you of any non-refundable components at the time of booking.

6.3 Cancellation by Bigtime Travel

We reserve the right to cancel a confirmed booking in the following circumstances: if the minimum group size required for a group tour is not met (we will offer alternative date, alternative package, or full refund); if a destination becomes unsafe, inaccessible, or unsuitable for travel due to natural disasters, political unrest, pandemics, government advisories, or other compelling reasons; if a Third-Party Service Provider fails to deliver the booked services and no reasonable alternative is available; or if full payment is not received by the specified deadline despite reminders.

In the event of cancellation by us, you will be entitled to a full refund of all payments made, or we will offer you an alternative tour package of equivalent value. We will not be liable for any other expenses, losses, or inconvenience caused by such cancellation.

6.4 Refund Processing

Approved refunds will be processed within 15 to 30 business days from the date of cancellation approval. Refunds will be made through the same payment method used for the original payment, or by bank transfer to your designated account. Any bank charges or processing fees associated with the refund will be deducted from the refund amount.

All Travelers are expected to maintain appropriate standards of behavior throughout the trip. The following behaviors are strictly prohibited and may result in immediate termination of services without any refund:

If a Traveler is removed from a tour due to violation of this Code of Conduct, no refund will be provided for the unused portion of the tour. The Traveler will be solely responsible for their own return travel, accommodation, and any other expenses incurred thereafter.

9. Limitation of Liability

To the maximum extent permitted by applicable Indian law:

While we make every effort to ensure the accuracy of information provided on our website, in our itineraries, and in our marketing materials, we do not guarantee that all information is error-free. We reserve the right to correct any errors and to update information at any time without prior notice.

10. Travel Insurance

We strongly recommend that all Travelers purchase comprehensive travel insurance before commencing their trip. Travel insurance should ideally cover: medical emergencies and hospitalization expenses, trip cancellation and interruption, lost/stolen/delayed baggage, missed connections and flight delays, personal accident and disability, emergency medical evacuation and repatriation, and legal liability and personal liability.

We can facilitate travel insurance through our partner insurance providers at competitive rates. However, the insurance policy is a contract between you and the insurance company, and Bigtime Travel is not a party to that contract. We are not liable for any claim denials, disputes, or issues arising from your travel insurance policy. If you choose not to purchase travel insurance, you acknowledge that you are solely responsible for all expenses arising from medical emergencies, trip cancellations, lost baggage, or any other unforeseen events during your trip.

11. Force Majeure

Neither party shall be liable for any failure or delay in performing its obligations under these Terms if such failure or delay is caused by a Force Majeure Event. Force Majeure Events include but are not limited to:

In the event of a Force Majeure Event, we will make reasonable efforts to provide alternative arrangements or reschedule the trip. If alternative arrangements are not feasible, we will provide a pro-rata refund for the services not delivered. We shall not be liable for any additional expenses, losses, or inconvenience caused by the Force Majeure Event.

12. Intellectual Property

All content on our website and in our marketing materials, including but not limited to text, graphics, logos, images, photographs, videos, icons, designs, layouts, compilations, software, and the overall look and feel of the website, is the property of Bigtime Travel or its content suppliers and is protected by Indian and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any materials from our website without our prior written consent, except for personal, non-commercial use on your own computer or device. Any use of our intellectual property for commercial purposes without our express written permission is strictly prohibited and may result in legal action. The "Bigtime Travel" name, logo, and any related trademarks and service marks are the exclusive property of Bigtime Travel.

13. Notification and Communication Consent

By accepting these terms, you acknowledge and consent to receive notifications and promotional communications from us through various channels, including but not limited to email, mobile push notifications, SMS, RCS (Rich Communication Services), WhatsApp, or any other digital communication platforms.

This consent is provided in connection with and is supplementary to the consent given under our Privacy Policy. The consent covers service-related notifications and promotional communications as detailed in our Privacy Policy, Section 4 (Notification and Communication Consent).

Opting out of marketing communications will not affect your ability to receive essential service-related notifications for active bookings.

Your use of our website and services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy explains how we collect, use, store, and protect your personal information. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

You agree to indemnify, defend, and hold harmless Bigtime Travel, its directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, demands, suits, actions, proceedings, losses, damages, costs, expenses (including reasonable legal fees), and liabilities arising out of or in connection with:

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or our services, you agree to first attempt to resolve the dispute through good-faith negotiation with us by contacting us at info@bigtimetravel.shop or calling +91 99448 32197.

If the dispute cannot be resolved through negotiation within 30 days, you agree that the dispute shall be referred to mediation through a mutually agreed mediator in Chennai, Tamil Nadu. If mediation is unsuccessful, the dispute shall be subject to the exclusive jurisdiction of the courts in Chennai, Tamil Nadu, India, and you irrevocably submit to the jurisdiction of such courts.

We reserve the right to amend, modify, or update these Terms at any time at our sole discretion. Changes will be effective immediately upon posting the revised Terms on our website with an updated "Last Updated" date. We may also notify you of significant changes through email or a prominent notice on our website. Your continued use of our website and services after the posting of revised Terms constitutes your acceptance of the amended Terms. It is your responsibility to review these Terms periodically for changes.

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of laws principles. All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Chennai, Tamil Nadu, India, as specified in Section 16.
